For a firearm<br \/>\n    purchased from a distributor or gun shop, the customer must first contact the seller from whom the purchase was<br \/>\n    made, without prejudice to the possibility of requesting technical assistance from the manufacturer.<\/p>\n<p>For orders placed through the online shop, the party responsible for withdrawal and the legal guarantee is the seller<br \/>\n    identified during checkout, in the order confirmation and in the tax document.<\/p>\n<h2>Withdrawal for change of mind<\/h2>\n<p>The Consumer, meaning the natural person who purchases for purposes unrelated to their business, commercial, craft or<br \/>\n    professional activity, has 14 days to withdraw from the distance contract without giving any reason, subject to the<br \/>\n    exceptions provided by law.<\/p>\n<p>For a single item, the period begins on the day on which the Consumer, or a third party other than the carrier and<br \/>\n    designated by the Consumer, takes physical possession of the product.<\/p>\n<p>For several goods ordered in a single order and delivered separately, the period begins upon delivery of the last<br \/>\n    item. For goods consisting of multiple lots or pieces, it begins upon delivery of the last lot or piece.<\/p>\n<p>The online function for exercising the right of withdrawal is available below:<\/p>\n<p class=\"mb primary-color\"><a class=\"wcew-withdrawal-link\" href=\"https:\/\/www.fossari.it\/en\/request-withdrawal\/\">Withdraw from the contract here<\/a>\n<p>The function allows the Consumer to identify the order, provide or confirm the necessary information, select the<br \/>\n    products concerned, view the summary and submit the withdrawal declaration.<\/p>\n<p>After submission, the system sends a confirmation on a durable medium without undue delay, normally by email,<br \/>\n    containing the submitted declaration, the relevant identification code and the date and time of submission.<\/p>\n<p>To meet the deadline, it is sufficient for the declaration to be submitted before the 14-day period expires.<\/p>\n<p>Use of the online function is recommended but not mandatory. The Consumer may also exercise the right by sending an<br \/>\n    explicit declaration to <a href=\"mailto:info@fossari.it\">info@fossari.it<\/a> or to the Seller\u2019s other<br \/>\n    contact details stated in the order confirmation.<\/p>\n<p>No specific wording is required, provided that the communication clearly expresses the decision to withdraw and<br \/>\n    allows the order to be identified.<\/p>\n<p>Exercising the right is not subject to prior authorisation or approval. After receiving the declaration, the Seller<br \/>\n    may communicate the operational instructions and the address to be used for the return.<\/p>\n<h2>Optional form and label<\/h2>\n<p>The PDF form and label available below are optional tools. They do not constitute conditions for the validity of the<br \/>\n    withdrawal, prior return authorisations or prepaid shipping labels, unless expressly stated otherwise.<\/p>\n<ul>\n<li><a href=\"\/wp-content\/uploads\/modulo-reso-FOSSARI-en.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Optional<br \/>\n            withdrawal form<\/a><\/li>\n<li><a href=\"\/wp-content\/uploads\/etichetta-reso.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Optional<br \/>\n            label with the address to print and attach to the parcel<\/a><\/li>\n<\/ul>\n<h2>Returning products<\/h2>\n<p>The Consumer must return or hand over the goods without undue delay and in any event within 14 days from the day on<br \/>\n    which they communicated their decision to withdraw. The deadline is met if the goods are sent before it expires.<\/p>\n<p>Where withdrawal is exercised because the Consumer has simply changed their mind, the direct costs of returning the<br \/>\n    goods are borne by the Consumer, unless otherwise agreed or unless the required prior information was not provided<br \/>\n    in the cases laid down by law.<\/p>\n<p>Tracked shipping and packaging suitable for the product\u2019s weight, dimensions and nature are recommended.<\/p>\n<p>For safety reasons, products must be shipped without any foreign object, ammunition or prohibited material. The Buyer<br \/>\n    must comply with any restrictions applicable to the transport of regulated accessories or components.<\/p>\n<p>The return must not be sent directly to the manufacturer\u2019s premises unless that address has been expressly stated in<br \/>\n    the instructions relating to the specific order.<\/p>\n<h2>Condition of the returned product and reduction in value<\/h2>\n<p>The Consumer may inspect and handle the product to the extent necessary to establish its nature, characteristics,<br \/>\n    compatibility and functioning, in a manner comparable to what would normally be allowed in a store.<\/p>\n<p>The product must be returned with any accessories, components, manuals, documents and equipment received.<\/p>\n<p>Where still available, the original boxes, labels, bags, seals, protective materials and packaging must be used or<br \/>\n    placed inside suitable outer packaging to reduce the risk of damage. The absence of the original packaging does not<br \/>\n    automatically result in the loss of the right of withdrawal.<\/p>\n<p>The Consumer is liable only for any actual reduction in the value of the goods resulting from handling beyond what is<br \/>\n    necessary to establish their nature, characteristics, compatibility and functioning.<\/p>\n<p>If a reduction in value attributable to such handling is found, the Seller may reduce the refund proportionally to<br \/>\n    the actual loss established, providing the reasons and the elements used to determine it.<\/p>\n<p>No fixed penalties of 60%, 80% or any other predetermined percentage apply. The product is not automatically sent<br \/>\n    back to the Consumer solely because the original packaging is missing or because it cannot immediately be resold as<br \/>\n    new.<\/p>\n<h2>Refunds in the event of withdrawal<\/h2>\n<p>In the event of a valid withdrawal, the Seller refunds the amounts due without undue delay and in any event within 14<br \/>\n    days from the day on which it was informed of the Consumer\u2019s decision.<\/p>\n<p>Unless the Seller has offered to collect the goods directly, it may withhold the refund until the products are<br \/>\n    received or until the Consumer provides evidence that they have sent them back, whichever occurs first.<\/p>\n<p>The refund is made using the same means of payment used for the purchase, unless otherwise expressly agreed, and does<br \/>\n    not result in any costs for the Consumer.<\/p>\n<p>In the event of withdrawal from the entire order, the refund includes the price of the products and the initial<br \/>\n    standard delivery costs, where due.<\/p>\n<p>Supplementary costs resulting from the choice of a delivery method other than the least expensive standard method<br \/>\n    offered by the Seller are not refunded.<\/p>\n<p>In the event of withdrawal concerning only some products, the price of the returned goods is refunded. Initial<br \/>\n    delivery costs are refunded only where and to the extent provided by applicable law; no automatic proportional<br \/>\n    refund is due where the delivery cost would have remained unchanged even without the returned products.<\/p>\n<p>No retroactive shipping charge is automatically applied solely because, after a partial withdrawal, the value of the<br \/>\n    products retained falls below any free-shipping threshold.<\/p>\n<h2>Exclusions from the right of withdrawal<\/h2>\n<p>The right of withdrawal is excluded in the cases provided for by Article 59 of the Italian Consumer Code, where the<br \/>\n    relevant requirements are actually met.<\/p>\n<p>In particular, it may be excluded for non-prefabricated goods produced on the basis of an individual choice or<br \/>\n    decision by the Consumer or clearly personalised goods, such as components made or adapted according to specific<br \/>\n    measurements, finishes or work that make them not normally resalable.<\/p>\n<p>The mere production or acquisition of the product after the order, the choice among standard variants or temporary<br \/>\n    lack of stock are not, by themselves, sufficient to exclude withdrawal.<\/p>\n<p>Any exclusion must be clearly stated before purchase on the product page, in the quotation, shopping cart or order<br \/>\n    summary.<\/p>\n<p>Where an order includes products subject to withdrawal and excluded personalised products, withdrawal remains<br \/>\n    available only for the products that qualify.<\/p>\n<p>The exclusion of withdrawal does not limit the legal guarantee for defective, damaged or incompatible products in<br \/>\n    relation to the confirmed information, or products otherwise not in conformity with the contract.<\/p>\n<h2>Commercial replacements<\/h2>\n<p>A replacement requested solely for commercial reasons, such as changing a correctly ordered and delivered model,<br \/>\n    size, colour or variant, is not the same as the right of withdrawal or the legal guarantee.<\/p>\n<p>The replacement may be accepted by the Seller in accordance with the commercial conditions communicated to the<br \/>\n    customer. The relevant return and new-shipment costs may be charged to the Buyer.<\/p>\n<p>The availability of an alternative product is not guaranteed until confirmed by the Seller.<\/p>\n<h2>Defective, damaged or non-conforming products<\/h2>\n<p>Requests concerning defective, damaged or non-conforming products are separate from withdrawal for change of mind and<br \/>\n    are handled under the legal guarantee.<\/p>\n<p>The product is conforming when it corresponds to the description, model, quantity, quality, measurement, variant,<br \/>\n    declared compatibility and other characteristics provided by the contract; is suitable for ordinary use and for any<br \/>\n    particular use accepted by the Seller; and is supplied with the promised accessories, documentation and<br \/>\n    instructions.<\/p>\n<p>Examples of possible conformity defects include:<\/p>\n<ul>\n<li>a product different from the one ordered;<\/li>\n<li>a component incompatible with the model or code expressly confirmed by the Seller;<\/li>\n<li>defects in materials, workmanship, finish or functioning;<\/li>\n<li>missing included components or accessories;<\/li>\n<li>damage occurring during transport;<\/li>\n<li>missing or inadequate instructions where necessary for correct use or installation.<\/li>\n<\/ul>\n<p>The Buyer\u2019s selection of an incompatible spare part despite correct and clearly available information before the<br \/>\n    order does not, by itself, constitute a defect.<\/p>\n<p>Damage caused exclusively by incorrect installation, improper adaptations, unauthorised modifications, use on<br \/>\n    incompatible models, misuse or failure to follow the instructions does not constitute an original defect. Product<br \/>\n    defects and incorrect information or instructions attributable to the Seller or Manufacturer remain covered.<\/p>\n<p>Work by an unauthorised person does not automatically eliminate every warranty: only problems causally attributable<br \/>\n    to the incorrect work may be excluded.<\/p>\n<h2>How to report a defect<\/h2>\n<p>The Consumer may report a defective, damaged or non-conforming product by writing to <a\n        href=\"mailto:info@fossari.it\">info@fossari.it<\/a> or to the different contact address stated in the<br \/>\n    order confirmation.<\/p>\n<p>To facilitate handling, it is useful to state:<\/p>\n<ul>\n<li>the order number;<\/li>\n<li>the product and relevant code;<\/li>\n<li>the model, gauge, version or serial number relevant to compatibility;<\/li>\n<li>a description of the problem;<\/li>\n<li>photographs or videos of the product, packaging and any damage.<\/li>\n<\/ul>\n<p>Photographs, videos or other evidence may be requested only where reasonably useful and must not become an obstacle<br \/>\n    to exercising the guarantee.<\/p>\n<p>Use should be stopped immediately where the problem may affect the safety of the product or of the firearm on which<br \/>\n    the component is installed.<\/p>\n<p>The problem should be reported without delay. No two-month forfeiture period from discovery of the defect applies to<br \/>\n    the Consumer.<\/p>\n<p>The return is not subject to a discretionary assessment of acceptance or refusal. The Seller may inspect the defect<br \/>\n    and communicate the operational method required to apply the remedies provided by law.<\/p>\n<h2>Remedies under the legal guarantee<\/h2>\n<p>Where the Buyer is a Consumer, the Seller is liable for any lack of conformity existing at the time of delivery and<br \/>\n    becoming apparent within two years.<\/p>\n<p>The action seeking the remedies provided for defects not fraudulently concealed is time-barred twenty-six months<br \/>\n    after delivery.<\/p>\n<p>Unless proved otherwise, a defect becoming apparent within one year of delivery is presumed to have existed at<br \/>\n    delivery, unless that presumption is incompatible with the nature of the goods or the defect.<\/p>\n<p>In the event of a lack of conformity, the Consumer is first entitled to restoration through repair or replacement,<br \/>\n    free of charge, within a reasonable period and without significant inconvenience, unless the chosen remedy is<br \/>\n    impossible or involves disproportionate costs compared with the alternative.<\/p>\n<p>Where the conditions laid down by law are met, the Consumer may obtain a proportionate price reduction or termination<br \/>\n    of the contract.<\/p>\n<p>Termination is not permitted where the defect is minor. The burden of proving that the defect is minor lies with the<br \/>\n    Seller.<\/p>\n<p>Where the product must be made available for inspection, repair or replacement, the necessary transport costs are<br \/>\n    borne by the Seller.<\/p>\n<p>The original packaging may be recommended but is not an automatic condition of the guarantee.<\/p>\n<p>In specific cases, the Seller may decide not to require the return of the defective product. This choice is an<br \/>\n    operational method and does not limit the remedies recognised by law.<\/p>\n<h2>Commercial warranty and manufacturer assistance<\/h2>\n<p>Any commercial warranty offered by F.A.I.R.<sup>\u00ae<\/sup> S.r.l. is additional to the legal guarantee and does not<br \/>\n    replace or limit it.<\/p>\n<p>For problems relating to a F.A.I.R.<sup>\u00ae<\/sup> shotgun purchased from a distributor or gun shop, the customer must<br \/>\n    contact the seller from whom the purchase was made. The customer may also request technical assistance from the<br \/>\n    manufacturer through the contact details published on the Website.<\/p>\n<p>Repairs, adaptations and work on essential parts of the firearm must be carried out by the manufacturer or by a<br \/>\n    gunsmith, repairer or qualified technician. The warranty may exclude damage caused by improper work, but not<br \/>\n    original defects without a causal link to such work.<\/p>\n<h2>Transport costs for returns<\/h2>\n<p>The following table is retained in the operational format already published.
